Scenity — Terms of Service

Welcome to Scenity. These Terms of Service ("Terms") are a binding agreement between you and Scenity ("Scenity," "we," "us," or "our") and govern your use of the Scenity mobile application and the services provided through it (the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
1. Who May Use the Service
You must be at least 13 years old to use Scenity, and at least 16 where required by the law of your country (such as in parts of the European Economic Area). By using the Service, you confirm that you meet the minimum age that applies to you and that you are able to enter into a binding agreement.
If you use the Service on behalf of a business (for example, by claiming a venue), you confirm that you are authorized to act on that business's behalf.
2. Your Account
To use most features, you must create an account using your email address or by signing in with Google or Apple.
You are responsible for:
- Providing accurate information and keeping it up to date.
- Maintaining the security of your account and login credentials.
- All activity that occurs under your account.
Notify us promptly if you believe your account has been accessed without your permission. We are not responsible for losses caused by unauthorized use of your account where you have not kept your credentials secure.
3. The Service
Scenity lets you discover places, save them, organize them into lists, write notes, follow other people, and receive personalized recommendations based on your taste. Some information about places is provided by third parties, including Google.
We may change, add, or remove features of the Service at any time. We may also suspend or discontinue the Service, in whole or in part, though we will try to give reasonable notice where practical.
4. Your Content
"Your Content" means anything you create or upload through the Service — including lists, saved places, notes, photos, tags, posts, and profile information.
You keep ownership of Your Content. You are not giving up your rights to it.
License to us. To operate the Service, you grant Scenity a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute Your Content, for the purpose of providing, operating, and improving the Service. For content you make public (such as public lists or a public profile), this license extends to showing that content to other users and visitors, consistent with your visibility settings.
This license also allows us to create and use aggregate, de-identified information derived from Your Content and your activity — that is, insights computed across many users that do not identify you and from which you cannot be identified. We may use such aggregate, de-identified information to operate, improve, and develop the Service and related analytics products. We do not sell Your Content, and we do not sell or disclose your individual saved places, notes, or taste profile. Any commercial use of insights is at the aggregate, group level only, as described in our Privacy Policy.
This license ends when you delete Your Content or your account, except that: (a) content you shared with others may continue to exist where those others have not deleted it; (b) we may retain copies as required to comply with legal obligations; and (c) aggregate, de-identified information that no longer identifies you and is not linked to your account is not affected by deletion, since it is no longer personal to you.
Your responsibility. You are responsible for Your Content and confirm that you have the rights necessary to share it, and that it does not violate these Terms or any law.
5. Acceptable Use
You agree not to:
- Use the Service in any way that violates the law or the rights of others.
- Post or share content that is illegal, harmful, harassing, hateful, threatening, deceptive, or infringing on others' rights.
- Impersonate any person or misrepresent your affiliation with any person or business.
- Upload viruses, malicious code, or attempt to interfere with, disrupt, or gain unauthorized access to the Service or its systems.
- Scrape, harvest, or collect data about other users or the Service without our permission.
- Use the Service to send spam or unsolicited communications.
- Misuse the place-claiming or business features, including claiming a venue you are not authorized to represent.
- Attempt to reverse-engineer or extract the underlying models, data, or source code of the Service, except where permitted by law.
There is no tolerance for objectionable content or abusive behavior on Scenity. Content that violates these rules will be removed and the accounts responsible terminated, typically within 24 hours of a report. Users can report objectionable content and block abusive users directly within the app.
We may remove content or suspend or terminate accounts that violate these Terms.
6. Places, Business Claims, and Third-Party Information
Some information in the Service — including place names, categories, photos, opening hours, and descriptions — comes from third parties such as Google. We do not guarantee that this information is accurate, complete, or up to date.
If you claim a venue as a business owner, you may edit certain information about that venue. You are responsible for ensuring that the information you provide is accurate and that you are authorized to represent the venue. We may remove or reverse a claim or an edit that we believe is unauthorized or inaccurate.
The Service may link to or integrate with third-party services (such as maps or directions). We are not responsible for third-party services, and your use of them is governed by their own terms.
7. Intellectual Property
The Service — including its software, design, features, and the Scenity name and branding — belongs to Scenity and is protected by intellectual property laws. Except for Your Content, we do not grant you any rights to the Service beyond the right to use it in accordance with these Terms.
You may not use the Scenity name, logo, or branding without our prior written permission.
8. Feedback
If you choose to send us ideas, suggestions, or feedback about the Service, you agree that we may use them without any obligation to you — we are not required to keep them confidential, to compensate you, or to credit you. Please do not send us feedback that is confidential or that belongs to someone else.
9. Privacy
Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you agree to the practices described there.
10. Termination
You may stop using the Service and delete your account at any time, directly in the App.
We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or to protect the Service or other users. Where reasonable, we will try to notify you.
When your account is deleted, your personal information is handled as described in our Privacy Policy. Some provisions of these Terms, by their nature, survive termination — including ownership, disclaimers, limitation of liability, and dispute provisions.
11. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that recommendations, place information, or other content will be accurate or suitable for your needs.
Recommendations and place information are provided for general informational purposes. You are responsible for your own decisions about where to go and what to do.
12. Limitation of Liability
To the fullest extent permitted by law, Scenity will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service.
To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or a nominal amount where you paid us nothing.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
13. Indemnification
To the extent permitted by law, you agree to indemnify and hold Scenity harmless from claims, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of the rights of another.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you within the App or by other appropriate means before they take effect. By continuing to use the Service after the changes take effect, you agree to the updated Terms. The "Last updated" date reflects the most recent version.
15. Governing Law and Disputes
These Terms are governed by the laws of Germany, without regard to conflict-of-law rules. Any disputes will be resolved in the courts of Germany, unless the mandatory law of your country of residence gives you the right to bring proceedings elsewhere.
Nothing in these Terms affects mandatory consumer-protection rights that apply to you under the law of your country of residence.
16. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Scenity regarding the Service.
- Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not transfer your rights under these Terms without our consent. We may transfer ours in connection with a merger, acquisition, or sale of assets.
